  • Press Conference: MN Office of Cannabis Management Announces Next Steps for Cannabis Licensing Process (Dec 11, 2024)
    Dec 11 2024

Comment, question, or idea for the podcast? Send us a Text Message!

Today, the Office of Cannabis Management (OCM) announced its next actions to launch Minnesota’s cannabis industry following a Ramsey County District Court judge’s decision to stay the cannabis license preapproval lottery originally scheduled for Nov. 26.

To avoid further delay and risks to social equity, OCM is ending the license preapproval process and moving forward with opening a standard licensing cycle for both social equity and general applicants beginning early next year. This step allows the office to prevent delays to the market launch due to ongoing litigation and retain some benefit to social equity by allowing applicants for license preapprovals to move into this new round.

The 2024 law that established the license preapproval process emphasized rigorous review and operational readiness to ensure that social equity applicants were market-ready. The delays related to the court’s order to pause the lottery eliminate any early-mover advantages offered by the expedited license preapproval process envisioned by the Legislature. Therefore, the lawsuits brought by some unsuccessful applicants necessitate moving directly to the licensing cycle for both social equity and general applicants.

“We remain committed to launching an equitable, sustainable, and responsible cannabis marketplace in Minnesota,” said OCM Interim Director Charlene Briner. “Our path forward ensures we remain on track to launch Minnesota’s new cannabis market and also preserves some of the social equity benefits that were at the heart of the preapproval process and that are foundational to the law as it was originally conceived.”

Thank you to Fox News for recording this Press Conference after our request was denied by OCM.

  • Bonus: Reactions to District Court Decision (w/ Jen Randolph Reise, Leili Fatehi, and Jeff Brinkman)
    Nov 29 2024

Comment, question, or idea for the podcast? Send us a Text Message!

In this bonus episode of Northern Lights, we dive into the recent decision by the District Court to stay the Minnesota Office of Cannabis Management’s (OCM) Social Equity Preapproval Lottery. This ruling has sent ripples through Minnesota’s cannabis community, sparking debates about fairness, preparedness, and the future of this nascent industry. Nearly 18 months have passed since Governor Walz signed the legalization bill into law, yet the cannabis industry remains in limbo. In this episode, we explore the multifaceted perspectives on this decision, what it means for the OCM, prospective cannabis businesses, and the broader community eagerly awaiting progress.

We begin with Jen Randolph Reise of North Star Law Group, a firm behind one of the lawsuits heard in court this week. Jen explains what distinguishes her plaintiffs and why she believes Minnesotans deserve a fair process for rolling out the cannabis industry. She emphasizes that the lawsuit’s focus is not on obstructing progress but on ensuring that social equity applicants aren’t disadvantaged by what she describes as an inequitable process within the OCM.

Next, we hear from Leili Fatehi of Blunt Strategies, a prominent cannabis consulting firm in Minnesota. Known for leading the successful MN is Ready campaign to legalize adult-use cannabis, Leili argues that this process, while frustrating to those who received denial letters, is a necessary step to uphold the integrity of the industry. She critiques the court’s actions, highlighting the negative impact of delays on businesses poised to begin operations, and underscores her belief that the OCM’s approach is necessary to filter out bad actors.

Finally, Jeff Brinkman of Superior Cannabis Company shares his concerns about the OCM’s handling of the preapproval lottery. Having followed the courtroom arguments closely, Jeff critiques what he perceives as the OCM’s lack of understanding in creating a transparent and functional regulatory process. He reflects on the need for better communication and collaboration to avoid further missteps and to ensure the industry develops as intended.

To round out the episode, we share the OCM’s official statement, providing their perspective on the court’s decision and their vision for moving forward. While opinions on these events may vary, we believe all stakeholders can unite behind the shared goal of building a fair, efficient, and inclusive cannabis industry in Minnesota.

This moment may feel like a setback, but every challenge brings an opportunity to learn and improve. The vision for Minnesota’s cannabis industry is one of inclusion, opportunity, and community benefit. It’s a vision worth fighting for, and the voices we’ve heard today remind us why it matters. Let’s hope the next steps, whatever they may be, bring us closer to that vision.

  • S2:E11 | The Courts Send OCM a Denial Letter (with Sean Paul Kehren)
    Nov 26 2024

Comment, question, or idea for the podcast? Send us a Text Message!

It’s been a week in the Minnesota cannabis world, and Steve and Tanner are here to break it all down. The Office of Cannabis Management (OCM) scheduled the first round of its Social Equity Preapproval Lottery… and then the District Court stepped in with a stay, temporarily halting the process. Next step, Minnesota Court of Appeals.

Meanwhile, Minneapolis and Duluth are busy considering cannabis ordinances, each putting their own spin on what regulation should look like for retailers and parks.

On the business side, things aren’t much smoother. Employees at Vireo are on the brink of a strike after slow-moving contract negotiations with UFCW Local 1189, threatening to throw half of the state’s medical cannabis program into disarray. And in slightly lighter news, a study from the University of Minnesota shows that students are trading heavy drinking for cannabis. Call it progress?

This week’s episode also features an interview with Sean Paul Kehren of North Star Law Group. Sean shares stories about growing up in Pine City, his path to becoming a lawyer, and what’s driven him to navigate Minnesota’s cannabis legal landscape. Quick note: North Star’s lawsuit against OCM hadn’t been filed yet when we recorded this conversation.

To unwind, we sample Modist Brewing’s new Melt Pop’s flavors—Citrus Punch and Sangria Ginger Ale—and Tanner treats us to Big Cat Hash’s Strawberry Pie for another Terp Tasting. As always, we end with a high note, trying to find some joy in the everlasting and ever growing chaos.

Production Note: Most of this episode was recorded before the court’s decision on Monday. Even so, the conversations are still relevant—maybe even more so. We’ll be back later this week with more thoughts on that ruling.
